Car Rental Terms and Conditions

Driver Requirements and Age Restrictions

The driver must possess a valid driver’s license appropriate for the category of vehicle rented.

  • The minimum age for renting most vehicles is 23 years. For premium or high-end vehicles, the minimum age is 27 years. Some vehicles may require the driver to have held a valid license for at least 24 months.
  • Each rental may have different driver eligibility requirements. Please refer to the details of each vehicle on the home page for specific restrictions.

1. VEHICLE CONDITION

Upon both delivery and return of the vehicle, an inspection will be conducted by the renter and the agency representative. The renter agrees to return the vehicle in the same condition it was delivered, excluding normal wear and tear. Any damages incurred during the rental period will be the renter’s responsibility, and they may be charged for the repair costs.

The renter is responsible for keeping the vehicle clean during the rental period. If the vehicle is returned in an excessively dirty state (interior or exterior), a cleaning fee may be charged.

The vehicle will be provided with a specific amount of fuel, which will be documented at the start of the rental period. The renter is required to return the vehicle with the same level of fuel, or they will be charged for refueling costs.

2. MECHANICAL CONDITION

The renter acknowledges that the vehicle is in proper working condition when received. The renter is responsible for any damage resulting from misuse or negligence during the rental period. This includes, but is not limited to, engine damage due to improper driving, damage to the clutch, or damage to electronic systems.

Repairs for breakdowns due to normal wear and tear (e.g., engine issues, worn-out brakes, etc.) will be covered by the rental agency. The renter will not be held responsible for these.

The renter must monitor the vehicle’s performance and notify the rental agency immediately if any warning lights (e.g., engine, oil, brakes) appear on the dashboard.

3. TIRES

The vehicle is delivered with tires in good condition. The renter is responsible for any damage to the tires during the rental period, excluding normal wear.

If a tire becomes punctured, excessively worn, or damaged during the rental period, the renter must replace it with a new tire of the same brand and size, at their own expense.

The vehicle comes with a spare tire. In case of a flat tire, the renter is responsible for ensuring that the damaged tire is replaced, and the spare tire is returned in good condition.

4. DOCUMENTS

The renter will be provided with all necessary documents for the legal operation of the vehicle (e.g., vehicle registration, insurance card).

All vehicle-related documents must be returned at the end of the rental period. Failure to do so will result in administrative fees and daily charges until the documents are returned.

If any of the documents are lost during the rental period, the renter will be responsible for covering the costs of obtaining replacements.

5. PAYMENT AND DEPOSITS

The full rental amount must be paid in advance upon booking or at the time of vehicle pickup.

No deposit is required for standard rentals unless explicitly stated in the rental agreement for certain premium or high-value vehicles.

If the renter wishes to extend the rental period, they must notify the rental agency and pay the additional rental fees at least 48 hours before the original rental term expires.

Cancellations made 48 hours before the scheduled pickup will be refunded in full. Cancellations within 48 hours may incur a cancellation fee, subject to agency policy.

6. OFFENSES AND VIOLATIONS

The renter is responsible for all traffic, parking, and other violations incurred during the rental period.

The renter is required to inform the rental agency immediately if they are fined or if the vehicle is impounded during the rental period.

Any administrative costs or handling fees related to offenses will be charged to the renter in addition to the fine or penalty.

7. ACCIDENTS AND DAMAGE

If an accident occurs, the renter must gather all necessary information from other parties involved, as well as from any witnesses present. It is important not to admit fault or discuss liability at the scene. The renter should contact the nearest rental agency immediately and, if necessary, inform local authorities. A detailed report of the accident, along with any police documentation, must be submitted within two days of the incident (24 hours in case of theft).

The renter is responsible for covering the excess amount for damages if they are at fault, as per the specific terms of the vehicle’s insurance policy. This amount may vary based on the vehicle rented.

8. INSURANCE

Each vehicle rented through MarHire Car Agadir is covered by insurance, but the level of coverage differs depending on the vehicle. This may include coverage for accidents, theft, and fire, with varying excess amounts based on the vehicle category.

In the case of an at-fault accident, the renter will be liable to pay the applicable excess amount, which depends on the specific insurance policy of the vehicle rented.

The following are not covered by the insurance policy:

  • Damage to the vehicle’s interior, such as upholstery or the dashboard.
  • Damage or theft of personal belongings left inside the vehicle.
  • Theft of accessories, such as GPS devices, car keys, or radios.
  • Damage to the underside of the vehicle, or damage caused by reckless or negligent driving.

For specific details about the insurance coverage for the vehicle you are renting, please refer to the information provided in your rental agreement or contact the agency directly.

9. USE OF VEHICLE

The vehicle must not be used for transporting passengers for commercial purposes, carrying illegal goods, participating in any racing or sporting event, or towing other vehicles without permission.

Only drivers specified in the rental agreement are authorized to operate the vehicle. Unauthorized drivers are not covered by insurance, and any damage caused by them will be the renter’s responsibility.

Driving under the influence of alcohol or drugs is strictly prohibited and will result in the immediate cancellation of the rental agreement, along with liability for any damages.

10. ONLINE PAYMENT

All payments are securely processed through the Interbank Electronic Payment Center (CMI). By choosing to pay online, you confirm that you have the necessary authorization to use your selected payment method.

In case of a fraudulent transaction, all agreements between you and your card issuer, as well as MarHire Car Agadir, will apply.
