MarHire Car Agadir (“MarHire Car Agadir”, “we”, “us”, “our”) is the car rental agency of MarHire in Agadir, Morocco. MarHire is a registered travel company based in the United States and Morocco. We rent vehicles from MarHire’s own fleet and from contracted fleets operated under MarHire’s brand and standards, and our own team handles every booking, delivery, handover, support request and return.

1) Acceptance of Terms

By accessing our Website, making an inquiry, or completing a car rental booking, you (“Customer”, “you”) agree to these Terms & Conditions (“Terms”) and to any vehicle-specific conditions shown on the car page, checkout, and voucher/confirmation. If there is a conflict, the car page/voucher terms prevail for that booking.

We may update these Terms periodically; the version posted with a new update date applies to future bookings.

2) Definitions & Our Role

• Platform: The MarHire Car Agadir website, communications, and booking processes.
• Vehicle: The car assigned to your booking, from MarHire’s own fleet or a contracted fleet operated under MarHire’s brand.
• Rental Agreement: The contract signed at pick-up listing the vehicle, named drivers, insurance plan, fuel level and condition.
• Voucher/Confirmation: The binding booking confirmation you receive after payment/approval; it includes key terms (dates, vehicle category, insurance plan, pick-up/return location, contact).

3) Eligibility & Customer Responsibilities

• The minimum driver age depends on the vehicle, the city, and the insurance plan. It is shown on the car page and confirmed on your voucher (a higher minimum age usually applies to Zero-Risk Protection and to Premium/Luxury vehicles).
• A valid driving licence held for the required minimum period (typically 2+ years) is required. Higher requirements may apply for certain vehicle categories. An International Driving Permit (IDP) may be required for some licences.
• Only named drivers listed on the Rental Agreement may drive the vehicle.
• Provide accurate details (names, contacts, flight information, licence) and keep them updated.
• Read the car page and voucher, and arrive on time with the required documents and payment method.
• Follow Moroccan traffic laws and our team’s instructions at pick-up and return.

4) Quotes, Availability & Booking Formation

• Quotes are indicative until confirmed in writing (email/voucher).
• A booking exists only when a MarHire Car Agadir confirmation is issued.
• We may decline bookings that are unsafe, fraudulent, or unavailable.
• Vehicles are booked by category. Minor specification changes (e.g., “or similar” vehicle within the same class) may occur; if the exact model is unavailable, we may provide an equivalent or higher category.

5) Pricing, Currency & Taxes

• Prices are shown in EUR (viewable in MAD/USD in some cases). Your bank’s FX rate and fees are outside our control.
• Prices include the insurance plan assigned to the vehicle (see Section 8) unless stated otherwise on the car page.
• Optional extras (e.g., child seats, additional driver, fuel, one-way return to another city) may be charged and, where stated, payable at pick-up.

6) Payments, Deposits & Security Holds

All bookings require partial or full prepayment online. Any remaining balance is paid at pick-up, as stated during checkout or on your booking confirmation.

We use Stripe and other approved payment methods to process online payments securely. By making a payment, you authorise MarHire and its payment service providers, including Stripe, to charge the payment method you provide for the applicable booking amount and any other authorised charges under these Terms.

A security deposit may be requested at the start of the rental, depending on the insurance plan assigned to the vehicle:

• Basic Protection (Deposit + Excess): A refundable security deposit is collected at pick-up. Payment is by cash by default; card payment is accepted where a card machine is available at the pick-up location.
• Smart No-Deposit / Premium Protection / Zero-Risk Protection: No security deposit is collected at pick-up.
• Premium/Luxury vehicles: A refundable security deposit by card may be required at pick-up, as shown on the car page and voucher.

The insurance plan and any deposit applicable to your vehicle are always displayed on the car page and confirmed on your voucher. Plan availability depends on the vehicle and city.

7) Force Majeure & Safety

If delivery of the vehicle is impossible or unsafe due to events beyond reasonable control (e.g., severe weather, road closure, natural disaster, strikes, civil authority orders), you may select a free reschedule or a full refund.

8) Insurance & Damage

All car rentals include Third-Party Liability and Full Insurance (CDW) for the rented vehicle. Depending on the vehicle and city, every rental is assigned one of four insurance plans:

What “full insurance” means in practice

• Driver at fault: The driver pays up to the excess cap of their plan (Basic, Smart, and Premium), based on the actual repair cost — never more than the cap and never more than the actual damage. Zero-Risk Protection drivers pay €0.
• Driver not at fault: The driver pays €0 across all plans, provided a full accident report is submitted and the insurer confirms non-fault.

Indicative excess caps by vehicle category

The exact excess for your vehicle appears on the car page and on your car documentation at pick-up.

Availability, deposit, excess, and minimum age vary by vehicle and city. Not every plan is offered on every car, and the minimum driver age differs between vehicles and plans. The plan(s) available for your booking, the exact excess, the deposit (if any), and the minimum driver age are shown on the car page and confirmed on your voucher.

Zero excess when not at fault (all plans): If an accident occurs and you are not at fault, you pay €0 provided you supply a full accident report (police report or signed constat amiable with third-party details) and the insurer confirms non-fault. Notify us immediately and submit documents within 24 hours (or the next working day).

If liability is shared, undetermined, or the third party is unknown (hit-and-run), the excess applies (fully or proportionally) until liability is confirmed. Zero-Risk Protection carries no excess in any scenario.

Glass & Windscreen: Damage to the windscreen, windows, and mirrors is covered under all four plans. No add-on is required.

Common exclusions: DUI/reckless driving; unauthorised drivers; off-road use; negligence (e.g., keys left in the vehicle); wrong fuel; clutch/gearbox misuse; undercarriage damage; wheels and tyres; lost keys; personal belongings. A police or insurer’s accident report is always required — without it, the customer is liable for the full cost of all damage regardless of plan.

9) Rental Conditions

Use & Territory: Morocco only, on paved public roads. No off-road driving, racing, or competition use. Obey all traffic and parking rules.

Pick-up & Return: Bring your passport, valid driving licence (IDP if needed), and the deposit where applicable (cash for Basic Protection by default, card where a card machine is available). Return the vehicle on time, in the same condition, and at the agreed fuel level. Late returns incur extra charges.

One-Way Returns: Returning the vehicle in another city is possible on request; the related delivery fee is payable by the customer and confirmed in writing before the rental.

Mileage: Unlimited kilometres apply on rentals of more than 6 days, as shown on the car page and on your voucher. For rentals of 6 days or less, our agent will review and approve your travel plan (main routes/cities) at pick-up. If you later drive beyond the agreed plan without prior approval, a non-compliance mileage fee will apply, starting from €40 and adjusted to the distance and impact on the vehicle/contract. To update your plan, contact us by WhatsApp or email and obtain written approval before you travel.

Fees & Fines: You are responsible for all traffic and parking fines, tolls, and related administrative fees incurred during your rental. These may be charged during or after the rental when notices are received.

Cleaning Fees: All vehicles are delivered clean and must be returned in the same condition. A vehicle returned dirty incurs a €10 cleaning fee. A vehicle returned excessively dirty and requiring deep cleaning incurs a €30 cleaning fee. This includes, but is not limited to, smoking residue, spills, stains, excessive sand or dirt, and pet hair or odours.

Breakdown & Accident: Call our support immediately and follow our instructions. Do not authorise repairs without our approval. Replacement vehicles depend on availability and the type of incident.

11) Reviews & User Content

By submitting reviews, photos, or feedback, you grant MarHire a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for marketing and quality purposes. We may moderate or remove unlawful, abusive, or irrelevant content.

12) Fraud, Chargebacks & Security

We may cancel bookings suspected of fraud or misuse. If you initiate a chargeback while a refund is in progress, we may pause the refund until your card issuer resolves the dispute to prevent double credit.

13) Privacy & Cookies

Your personal data is handled under our Privacy Policy and Cookies Policy (available on our site). Contact [email protected] to exercise your privacy rights.

14) Intellectual Property & Website Use

All content, trademarks, and code on the Website are owned by or licensed to MarHire and protected by intellectual property laws. You agree not to scrape, copy at scale, reverse engineer, or misuse the Website or booking flows.

15) Availability of Platform

We aim for continuous availability but do not guarantee uninterrupted access. Maintenance, upgrades, or network issues may cause downtime. We may alter, suspend, or discontinue any part of the Platform at any time.

16) Liability & Disclaimers

To the maximum extent permitted by law, our total liability for any claim related to a booking is limited to the amount you paid for that booking.

We are not liable for indirect, incidental, special, or consequential losses, or for events outside our reasonable control (force majeure).

Nothing in these Terms limits liability that cannot be limited under applicable law.

17) Severability, Assignment, No-Waiver, Entire Agreement

If any provision is invalid or unenforceable, the remainder remains in effect. You may not assign your rights without our consent. Our failure to enforce a term is not a waiver. These Terms, together with the voucher, car page conditions, and Rental Agreement, are the entire agreement for your booking.

18) Governing Law & Jurisdiction

These Terms are governed by Moroccan law. The Courts of Agadir (Souss-Massa) have non-exclusive jurisdiction, without prejudice to any mandatory consumer rights under applicable law.
